1. About the Service

PROFINDUSA is an online marketplace that lets brokerages, real estate agents and private owners publish property listings — residential, rental, commercial and land — and lets the public search them and contact publishers. PROFINDUSA is not a real estate broker, agent, lender, or party to any transaction between users.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.

3. Your Account

You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

4. Listings and Your Content

You are solely responsible for any listing, text, photo, video, tour or other content you publish (“Content”). You represent that you have the right to publish it and that it is accurate and not misleading. You must comply with all applicable laws, including the federal Fair Housing Act and state and local fair-housing laws: listings must describe the property, not state a preference, limitation, or discrimination based on race, color, religion, sex, disability, familial status, national origin, or any other protected class. You retain ownership of your Content and grant PROFINDUSA a non-exclusive, worldwide license to host and display it in connection with operating and promoting the Service.

5. Professionals and Recommendations

Any agents, brokerages or service professionals listed or promoted on the Service are provided as recommendations only. PROFINDUSA does not employ, endorse, verify or guarantee any professional. Verifying a professional’s license, insurance, references and suitability is solely your responsibility.

6. Prohibited Conduct

You agree not to: post false, fraudulent, or infringing content; scrape or harvest data; interfere with the Service or its security; use the Service for spam or unlawful purposes; or impersonate any person or entity.

7. Intellectual Property

The Service, including its design, logos and software, is owned by PROFINDUSA and protected by law. Except for your own Content, you may not copy, modify or distribute any part of the Service without our permission.

8. Disclaimers

The Service is provided “as is” without warranties of any kind. PROFINDUSA does not verify listings and does not guarantee the accuracy, availability, legality or condition of any property, price, or information. Any reliance on the Service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, PROFINDUSA and its affiliates will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of, or inability to use, the Service or from any dealing between users.

10. Reporting and Takedown

If you believe a listing is inaccurate, unlawful, or infringes your rights (including copyright), contact us and we will review and, where appropriate, remove it. We may remove content or suspend accounts at our discretion.

11. Termination

We may suspend or terminate access to the Service at any time for any reason, including violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
